First Amendment

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Article 1, Section 7. Freedom of Press and Speech; Libels.

The printing press shall be free to every person who may undertake to examine the proceedings of the Legislature or any branch of government, and no law shall ever be made to restrain the right thereof. The free communication of thoughts and opinions is one of the invaluable rights of man, and every citizen may freely speak, write and print on any subject, being responsible for the abuse of that liberty. No conviction shall be had in any prosecution for the publication of papers relating to the official conduct of officers or men in public capacity, or to any other matter proper for public investigation or information, where the fact that such publication was not maliciously or negligently made shall be established to the satisfaction of the jury; and in all indictments for libels the jury shall have the right to determine the law and the facts, under the direction of the court, as in other cases.

Although a cherished right of the people, freedom of the press is different from other liberties of the people in that it is both individual and institutional.

  Freedom of the press is not just for a licensed, for profit, entity, it is for the people, as a whole, to at all times, have access to the public records, except for matters of national security, and be able to print or publish without obstruction. First, when you have to get a license from the government to operate, and run, any type of news organization, you are asking for permission to do what is already allowed by the Constitution for the United States , and the Constitution for the Commonwealth of Pennsylvania . Founding Father Noah Webster in his 1828 Dictionary of the English Language defines license as: Leave; permission; authority or liberty given to do or forbear any act. A license may be verbal or written; when written, the paper containing the authority is called a license. To permit by grant of authority; to remove legal restraint by a grant of permission.

  Government can control the press in several ways.

  1.   When you obtain a license from the government you are giving up your right to freedom of speech and press by signing into a contract with the government to do what is already permitted. Also, you do what they want and how they want it or they can pull your license. "In a free and republican government, you cannot restrain the voice of the multitude."

  1.   Government ads are such a large part of the advertising profits to a news paper that they can tell a news group to not do certain things or they will pull their ads and go to another paper. "Our liberty depends on the freedom of the press, and that cannot be limited without being lost."

  1.   If the freemen of every state do not have access to the press and to the public records themselves, they have to rely on what a government sanctioned news organization tells them. "Republics are created by the virtue, public spirit, and intelligence of the citizens. They fall, when the wise are banished from the public councils, because they dare to be honest, and the profligate are rewarded, because they flatter the people, in order to betray them." Joseph Story

 

  Founding Father Noah Webster in his 1828 Dictionary of the English Language defines press as: Liberty of the press, in civil policy, is the free right of publishing books, pamphlets or papers without previous restraint; or the unrestrained right which every citizen enjoys of publishing his thoughts and opinions, subject only to punishment for publishing what is pernicious to morals or to the peace of the state. The art or business of printing and publishing. A free press is a great blessing to a free people; a licentious press is a curse to society.

 

  It was to be the sole duty of the people, to be able to hold their government in check, by being able to publicly announce what their government was doing, whether the government was right or wrong in its workings. Remember, that the sole arbiters of power are the people, as Thomas Jefferson said "The ultimate arbiter is the people of the Union ". Jefferson also said: The constitutions of most of our States assert that all power is inherent in the people; that they may exercise it by themselves in all cases to which they think themselves competent, or they may act by representatives, freely and equally chosen; that it is their right and duty to be at all times armed; that they are entitled to freedom of person, freedom of religion, freedom of property, and freedom of the press.

 

 

  The press should only answer to the people, not the government. Press can still be for profit by means of the people, who will purchase and advertise with it, because it is unrestricted and unregulated by the government. It should never answer to, or make a profit from the government, for this is the end of freedom of the press and speech.
